Corporate Recovery & Insolvency
In a complex and increasingly global marketplace, all businesses face rapid change. Profitability can be dramatically and suddenly affected by the loss of an overseas market, the demise of a key customer or the impact of competition.
Wider economic circumstances can quickly change trading conditions, forcing companies into difficulties. While many problems are unforeseeable, and do not reflect negatively on a company’s management, the impact can be severe, often threatening the very survival of the business.
Solutions to these problems require decisive advice, strong leadership and depth of experience: JBL’s business support team is based on all these core elements.
We provide a bespoke team to each of our clients to deliver practical solutions in difficult times. Our breadth of expertise enables us to understand the whole of our clients’ businesses, not just individual parts. One guiding principle overrides our approach – to work in partnership with our clients to find solutions that work for them.
We work with our clients, their banks and other professional advisers to build strategies that deliver results, focusing on financial discipline, sound structure, appropriate investment and banking arrangements and the protection of brands and goodwill. We dare to innovate and will be straightforward in giving advice. That is central to our approach.
There are few business people – whether a sole trader or director of a large limited company – who will not face financial difficulties at some point in their careers. Many will need expert help, to avoid the fate of at least 50 companies in England and Wales that become insolvent each week.
If your business is facing financial difficulties, seeking expert advice as soon as possible can make all the difference to your future. Together we can assess your business and your financial position, and explore your options for keeping the business going and minimising potential losses.
Appropriate solutions for clients facing this kind of financial challenge may include reorganisation, refinancing, disposal or debt restructuring, with a view to avoiding insolvency wherever possible.
If the situation is more serious, we can advise and assist you in making informed decisions about the insolvency procedure that is most appropriate for you and your circumstances.
If you are a creditor, we can also advise on the best options for achieving recovery of the debt and assist in arranging for bankruptcy, winding up or receivership of a debtor if this is not successful.
We deal with:
- Corporate insolvency, involving administrations, company voluntary arrangements, pre-pack sales and purchases of businesses, liquidations, recovery of assets. We will advise on pre-insolvency strategies, security and reorganisations.
- Personal insolvency involving all aspects of bankruptcy with particular emphasis on property-related transactions and individual voluntary arrangements
- Forensic recovery work. We work as a team with specialist forensic accountants on the recovery and tracing of hidden assets, following the identification of fraud. This specialist service is provided through a dedicated, expert team with the right skills in contentious work, who know and understand the case and the court procedures necessary for success. Our specialist lawyers work on the case from start to finish, no matter how long it takes, with fee structures tailored to the work required.
- We are experienced in dealing with directors’ disqualifications. We have often acted for directors in defending disqualification proceedings, making applications on behalf of disqualified directors for permission to carry on as a director, and negotiating with the Secretary of State in relation to voluntary disqualification undertakings.
